IVISUAL PRODUCTIONS PRIVACY POLICY

Thank you for using iVisual Productions services and products! In the context of the AVG and GDPR legislation we have prepared this privacy policy document.

This privacy policy also addresses your use of iVisual Productions website and payment services.

When this policy states “iVisual Productions,” “we,” “our,” or “our,” the iVisual Productions company is responsible for your information in the privacy policy (the “data controller”).

Payments under the Payment Terms of Service (“Terms of Payment”). When you make the Payments, you also provide your information, including personal information, to you or your customer.

iVisual Productions includes all entities that are executed by iVisual Productions, where:

 

1. INFORMATION WE COLLECT

There are three general categories of information that we collect.

1.1 Information that you give us.                                                                                                                                                        1.1.1 Information required for contact via the iVisual Productions platform.

We request and collect the following personal information about you when you use the iVisual Productions platform. This information is necessary for the proper execution of the contact and any contract between you and us and to enable us to meet our legal obligations. Without this we may not be able to offer you all the requested services.

Payment information. To use certain functions of the iVisual Productions platform (such as paying an invoice), we may ask you to provide certain financial information (such as your bank account, Paypal or credit card details) to facilitate the processing of payments. 

1.1.2 Information that you want to give us.

You can choose to provide us with additional personal information to get a better user experience when using iVisual Productions platform. This additional information will be processed based on your permission.

Additional profile information. You can choose to provide additional information as part of your iVisual Productions profile (such as preferences, interests, sample photos, etc.). This information is managed purely by ourselves and not shared. You may need to give permission to share a shared photo with our partners, such as a make-up artist.

2. HOW WE USE INFORMATION THAT WE COLLECT

We use, store and process information, including personal information, about you in order to be able to offer, improve and develop all of our iVisual Productions services and to comply with our legal obligations.

2.1 Offering, improving and developing the iVisual Productions platform.

Initial contact usually takes place via email or a contact form. This data is usually sent via an external company that itself complies with the AVG or GDPR. This data ends up in our mail and in the future possibly in a CRM system.

2.2 Creating and maintaining a trusted and safer environment.

We are aware of security techniques such as https and other solutions. Wherever possible, we use external organizations with an impeccable reputation to optimize our services. In addition, we do our best to keep all technical aspects of our platform up-to-date and to protect it with antivirus, firewalls and other security software.

3. SHARING AND PUBLICITY

3.1 With your permission.

Where you have given permission, we will share your information, including personal information, as described at the time of permission, such as when you grant permission to an external party who cooperates in the project (for example, a make-up artist, stylist, graphic designer, etc.).

3.2 Payments.

iVisual Productions payments will have to share your information, sometimes including personal information, to ensure that our agreement with you is adequate. We will send an invoice including a 50% payment before delivering the product. We would like to ask you to transfer this declaration to our account as held within 14 days. 

3.3 Social Media Platforms.

If permitted by you, we may share certain limited information about you in consultation on social media platforms such as work-in-progress, the best photo or video from the shoot, etc. These processing activities are based on our legitimate interest in undertaking marketing activities to provide you with potential offering customers products or services.

3.4 Collection and payment of occupancy taxes.

In the event of non-compliance with payments, payment details will be passed on to collection agencies to arrive at a payment arrangement.

4. OTHER IMPORTANT INFORMATION

4.1 Analysis of your communication.

We can review, scan or analyze your communication on the iVisual Productions platform for research, product development and customer support. In some cases, we can also scan, review or analyze messages to improve and expand the product range. We will not review, scan or analyze your messages to send third-party marketing messages to you. These activities are performed based on the legitimate interest of iVisual Productions to ensure compliance with applicable law and our Terms, to prevent fraud, to promote security and to improve and guarantee the adequate performance of our services.

5. YOUR RIGHTS

You can exercise the rights described in this section for your applicable iVisual Productions data controller by sending an email to info@ivisualproductions.nl. Please note that we may ask you to verify your identity before we take further action on your request.

5.1 Your information.

The only information we have from you is the information that you have given us via the website, telephone or e-mail. This information is stored with, among others, a mail provider that complies with the GDPR.

5.2 Rectification of incorrect or incomplete information.

You have the right to ask us to adjust incorrect or incomplete personal information about you.

5.3 Access to data and portability.

In some jurisdictions, applicable law may give you the right to request copies of your personal information that we hold. We can provide you with the relevant e-mails as far as we still have them and if technically possible.

5.4 Data Retention and deletion of your data and data.

We generally keep your personal data for as long as necessary for the performance of the contract between you and us and to meet our legal obligations. If you no longer want us to save your information, you can ask us to delete your personal information. This also applies to the products made (such as photos delivered by us). Please note that if you request the removal of your personal information:

  1. We may store some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and improving security.
  2. We may store and use your personal data to the extent necessary to meet our legal obligations. For example, iVisual Production payments may store some of your information for tax, legal reporting and auditing obligations.
  3. Information that you have shared with others (for example, reviews, social media messages) may still be visible.
  4. We keep a backup of the data that we deem necessary for at least six months (if possible and no catastrophic IT problems arise), then there is a good chance that this data will be automatically deleted. You have the right to ask us to permanently remove it.
  5. We always ask if we can use photos or videos in the portfolio, if you have given your initial approval, then you are always free to withdraw this permission. Give us time to delete the portfolio item.
  6. Because we maintain the iVisual Productions platform to protect against accidental or intentional loss and destruction, any remaining copies of your personal information may not be deleted from our backup systems for a limited period of time.

 

5.5 Revoke withdrawal and limit processing.

If you have given your consent for the processing of your personal data by iVisual Productions, you can withdraw your consent at any time by sending us an email at info@ivisualproductions.nl. Please note that the withdrawal of your consent does not affect the legality of processing activities that are based on such consent before the withdrawal.

When your personal information is processed for direct marketing purposes, you can ask iVisual Productions to discontinue your data for these direct marketing purposes at any time by sending an email to info@ivisualproductions.nl.

5.6 Submitting complaints.

You have the right to make complaints about the data processing activities carried out by iVisual Production payments by sending an email to info@ivisualproductions.nl.

6. SAFETY

We continuously implement and update administrative, technical and physical security measures to protect your information from unauthorized access, loss, destruction or alteration. Some of the precautions we use to protect your information are firewalls, virus scanners, and data encryption. If you know or have reason to believe that your data has been lost, stolen, misappropriated or otherwise compromised or in the event of actual or suspected improper use of your data, please contact us.

7. CHANGES TO THIS PRIVACY POLICY

iVisual Productions reserves the right to change this Privacy Policy at any time in accordance with this provision. If we change this privacy policy, we will post the revised privacy policy on the iVisual Productions platform (website) and update the “Last updated” date at the top of this privacy policy. If you do not agree with the revised privacy policy, you can inform us of this. This does not indemnify you from canceling a current assignment.
